Signed Mib
Posted on Monday, June 7th, 2010 at 11:42 amWhat does indemnify mean? what does this letter mean?? MIB letter?
hi my son died in a car crash and his passenger is claiming from the Motor Insurance Bureau for his injuries.
I received a letter yesterday asking me to sign this agreement so the MIB can represent me.
it also said "i hereby agree to indemnify mib or thier agents, and to repay them all sums paid by them in respect of any settlement of any such claim (including the costs of the claimants).
what does this mean? i was told MIB would pay everything including his compensation, is this right?
what does this sentence in the agreement i have to sign mean??
I am going to phone them on Friday when the person dealing with it is there but i really want to know now.
please help
He did not have insurance while driving his car and that is why his friend is claiming through the MIB.
This was my sons car, he had insurance but then cancelled it. i was unaware of this. So i did not know anything about it. He had no estate. This accident was nothing to do with me.
I am a bit confused by your Q and I do not wish to add to the upset you will have at the death of your son. I obviously do not know the circumstances of the accident.
You speak as if your son was the driver and I assume this to be the case. I think you need to consider if you should consult your own solicitor privately as the involvement of the Motor Insurance Bureau suggests that there was no valid insurance cover in force for the use of the vehicle.
When a motorists takes out proper insurance a small part of all our premiums is paid as a levy by our Insurance Company into a fund to compensate injured victims of uninsured drivers. This compensation fund is managed by the MIB .. is this the body involved ? Was your son driving uninsured ? If so then whilst it would be logical for the passenger to try claiming from the MIB it is unlikely your son would have any death benefits.
For the benefit of any uninsured drivers, it is mostly young drivers, reading this it is worth remembering that the Police atomatic number plate detection facility can pick you out and your vehicle is liable to be crushed as part of the penalty.
Edit: the ref given by 'doethine' adds to the confusion as the one quoted by them is a private claims handling service and nothing to do with the MIB.
Edit 2. Following the additional details posted by you confirming your son was not insured I repeat my suggestion that you should consult a solicitor taking all the paper work to them. It is almost impossible for Q & A's to advise when all the MIB's letter content is not know. At it most blunt the words you have quoted suggest you will pay MIB their cost involved in the claim. Even though MIB may pay compensation to the injured passenger they may be entitled to try and get that money back themselves, possibly from your son's estate if he left anything, possibly from you if you are in some way responsible. This suggests a further issue you may not have given in your Q ..whose was the car ? was it yours ? are you in some way responsible because you yourself did not have insurance ? did you knowingly let your son drive without insurance ? too many loose ends to give you any answer.
